I recently purchased a gift card on EBAY and paid for it through PAYPAL. I recently found out the gift card was purchased with a fraudulent credit card and am out $500. I would like to file a civil complaint against this individual but their information is confidential (PAYPAL will not release without a subpoena). How can i file a subpoena or civil case when i don’t have this information?

You file a lawsuit against an anonymous person using John Doe as the name; allege all the necessary elements for fraud. After you’ve filed the case, you can subpoena the information (pursuant to discovery rules) from PayPal to figure out the defendant’s identity.
You should talk to an attorney. As it’s unlikely you can do this on your own. Try the complaint process first it’s less costly.
Good luck. They likely have about 20 attorneys on staff all the time.
Your only hope is to hire an attorney preferably based in “pay pals” home state. They are owned I beleive by eBay.
I don’t think you have a leg to stand on. Talk to the prosecutor or his assistant in the county where you live. THAT would be the best place to start.
If you pay paypal with a credit card you then have a little or a lot of protection for such scams. The chance of you recovering the money are slim and none.
Try to start working thru the ebay formats to report the scam and scheme. Do the same on the pay pal side. TALK to the police or prosecutor where you live.
Thats about it and I still don’t think you have a chance.
